Who this guide is for
Section actions
- You if you want to know how much leave you have acquired
- You if you leave your job and want to check leave with pay
- You if you are an employer/manager and calculate crew leave
To be prepared in advance
Section actions
- Payrolls for the period (for calculation)
- The contract and the collective agreement, to verify the conditions
- Leave dates already taken in the year
Step-by-step procedure
Section actions
- 1Determine the annual volume: 2,5 working days per month worked, maximum 30 working days (5 weeks) for a full year (1st June – 31 May — reference period).
- 2Check the week rule (English week): if you work 5 days per week, one week off = 6 working days; the "30th rule" for some.
- 3The leave with pay is calculated by two methods, and the employer pays the HIGHEST method of maintenance (such as the normal salary over the period) or the 10th method (10 % of the total gross salary in the year, including premiums).
- 4The 10th method is more favourable if significant premiums have been paid. Retention prevails if the salary is stable. The employer must retain the maximum.
- 5At the beginning/end of the contract: the compensatory allowance for paid leave pays for days not taken at departure. Check that the days are correctly counted.
- 6Sickness and absences influence acquisition: a month of absence beyond a threshold does not give 2,5 full days. Check on the newsletters.
- 7Leave not taken: if you have not applied (firm closure, etc.), the days are postponed or paid. Refusing to take leave is illegal — the employer must compel you to do so.
Common mistakes
Section actions
- Do not check which method (maintenance vs 10th) is applied — loss of money.
- Forget premiums in the 10th method — underpayment.
- Believing that leave not taken "severe". No — carry forward or payment.
- Count in calendar days instead of working days.
- Ignore reference period (1st June – 31 May), not calendar year.

Important remark
The calculation of paid leave depends on many factors (convention, type of contract). This information is indicative — for your case, check with bulletins and labour inspection.
